Starting Early and Integrating EIA into the Project Schedule

EIA should influence site, technology, and scale. If major contracts have been signed and design choices are irreversible, alternatives analysis becomes formal. The environmental team should join at concept and feasibility stage. The schedule includes notification, scoping consultation, seasonal fieldwork, the report, public participation, responses, and the conclusion. Biodiversity or hydrological studies may require more than one season. As of July 2026, the Ukrainian EIA Law indicates that certain amendments take effect on 16 September 2026 — projects with long schedules should verify the version applicable at every stage.

Scoping, Baseline, and Alternatives

The notification describes the activity, location, technical parameters, resources, potential effects, and alternatives. Good scoping does not study everything at the same level, but it does not exclude material issues without justification. Baseline information should be current, spatially relevant, and verifiable — national statistics do not replace local measurements where effects depend on the site. Reasonable alternatives — different site, technology, capacity, route, or no-project option — must be compared using transparent criteria. The no-project option shows how the area may develop without the proposal.

Assessing Effects, Mitigation, and Public Participation

The report covers construction, operation, accidents, closure, and dismantling, examining direct, indirect, short- and long-term, cumulative, and climate-vulnerability effects. The mitigation hierarchy prioritises avoidance, then minimisation, restoration, and only then compensation — compensation should not justify damage that could reasonably be avoided. Every mitigation measure needs an owner, deadline, technical description, performance indicator, and verification method. The public should receive understandable information and a genuine opportunity to comment before the decision; early community dialogue can identify local knowledge absent from open databases.

Conclusion, Decision, and Post-Project Monitoring

The competent authority issues a conclusion with environmental conditions. The later development decision must take that conclusion into account. Operating without complying with the conditions creates suspension and liability risk. Post-project monitoring tests predictions, verifies mitigation, and identifies unforeseen effects — results should feed back into operational management. For transboundary effects, consultations apply under international and national procedures.
